Terms of use
These terms govern your use of Fanout at fanout.oddete.com and its API ("the service"), operated by Oddete. By signing in or using the service you agree to them. If you do not agree, do not use the service. Please also read our privacy policy.
What the service does
Fanout sends the emails you compose through your own Gmail account, using the Gmail API with your permission, and merges values from a recipient list you provide. Every email is sent from your address, at your instruction, and is your responsibility.
Who can use it
You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding agreement. You may only connect a Google account that you own or are authorized to use. The service is not for children under 13.
Your Google account and permission
- By signing in you authorize Fanout to send email from your Gmail account, but only when you press Send in the Console or call the API with your key.
- Fanout asks only for send permission. It does not read your mailbox.
- You can revoke access at any time at myaccount.google.com/permissions or by deleting your account in the Console.
- You must follow Google's own rules, including the Google Terms of Service, the Gmail program policies and the Gmail sending limits. Google may restrict an account that breaks them, and that is outside our control.
Permission-based sending only
You may email only people who have a relationship with you and would reasonably expect to hear from you, such as customers, attendees, members or subscribers. You must have a lawful basis for contacting each recipient and you must honor requests to stop receiving your email.
Prohibited use
- Sending spam, unsolicited commercial email or chain messages.
- Using purchased, scraped or harvested address lists.
- Phishing, fraud, impersonation, malware, or deceptive or misleading content, including hiding who the email is really from.
- Harassment, hate, threats, adult content sent to people who did not ask for it, or anything unlawful.
- Breaking Google's terms or policies, or laws such as CAN-SPAM, CASL, GDPR and local anti-spam laws.
- Attempting to bypass the usage limits, overload or disrupt the service, probe it for weaknesses, or access other users' data.
- Reselling or sharing access, or running the service for third parties, without our written permission.
Usage limits
Each Google account may send up to 500 emails per rolling 24 hours and up to 500 recipients per send. Each CC address counts as an additional email. We may change these limits and may apply rate limits to protect the service. Gmail's own limits also apply and are outside our control. Exceeding them can restrict your Google account.
Unsubscribe
Every email includes a List-Unsubscribe header pointing to your address. You are encouraged to add your own unsubscribe instructions to the message body and to honor requests to stop receiving your email.
Your content
You own your recipient lists and email content. You are solely responsible for them, for having the right to use them, and for the emails you send. We process them only to send your emails and do not store them, as described in our privacy policy.
API keys and your account
Keep your API keys secret. You are responsible for all activity under your account and keys. If you think a key has been exposed, revoke it in the Console straight away. You can delete your account at any time.
Availability and changes
The service is provided free and we may change, limit or discontinue any part of it at any time. We do not promise it will always be available or error free.
Suspension and termination
We may suspend or end your access, without notice, if we believe you are breaking these terms, if we receive abuse complaints, or if needed to protect the service, other users or Google's systems. You may stop using the service at any time.
No warranty
The service is provided "as is" and "as available". We do not guarantee delivery, inbox placement, uptime, or that it will meet your needs. Delivery depends on Google and on recipients' email providers.
Limitation of liability
To the fullest extent permitted by law, Oddete is not liable for indirect, incidental or consequential damages, or for loss of data, profits, reputation or access to your Gmail account, arising from your use of the service. The service is free, and our total liability to you is limited to the amount you paid us, which is zero.
Your responsibility for claims
You agree to be responsible for any claims, complaints or losses that arise from the emails you send or your breach of these terms.
Changes and contact
We may update these terms and will change the date above when we do. Continued use after a change means you accept it. Contact: oddete.contact@gmail.com.
